Visa, along with other credit card companies, has had a complicated history with online gambling since it began in the mid-1990s. Initially, Visa and other credit card companies allowed their cards to be used for online gambling transactions. However, with the rise of internet gambling, concerns were raised about the potential for pathological and underage gambling and money laundering. According to the National Gambling Impact Study Commission, 95% of internet gambling businesses involve the use of credit cards.

In response to these concerns, the United States government passed the Unlawful Internet Gambling Enforcement Act (UIGEA) in 2006. The UIGEA made it illegal for financial institutions to process payments related to online gambling. As a result, credit card companies like Visa took a more cautious approach and many began to block or limit transactions for online gambling sites.

Major Visa Online Gambling Court Cases

The United States District Court for the Eastern District of Louisiana heard motions for multidistrict litigation alleging that Visa illegally interacted with several internet casinos. Re: Visa International Association Internet Gambling Litigation was a class action lawsuit filed on March 20, 2000, by several plaintiffs who claimed that Visa International had illegally interacted with several internet casinos. As a result, they suffered losses at various offshore online gambling sites. The plaintiffs alleged that Visa had violated the Wire Act, which prohibited the use of wire communications to transmit bets or wagers, and they sought monetary compensation for their losses.

On February 23, 2001, the District Court issued a decision, which the U.S. Fifth Circuit Court of Appeals later upheld. The Court clarified the Wire Act’s application to illegal online gambling and determined that the Wire Act is only applied to gambling activities related to a “sporting event or contest”. The plaintiffs also failed to demonstrate what losses they experienced at any sports betting site. As a result, the Court could not conclude that Visa violated the Wire Act. Furthermore, the Court stated that due to the ambiguous language regarding the “transmission of a wire communication,” internet casinos sending and receiving information were also not violating the Wire Act.

Another notable case is the U.S. v. Capital Processing Network and Scott Tucker, which was filed in 2012 and charged the defendants with operating an illegal online payday lending enterprise. The defendants were also accused of processing transactions for online gambling sites through fraudulent merchant categories, which allowed them to bypass Visa and Mastercard’s rules against processing transactions for illegal gambling sites.

How PASPA Overturn Affected Visa Sports Betting

The overturn of the Professional and Amateur Sports Protection Act (PASPA) in 2018 has significantly impacted Visa and other credit card companies in processing transactions for sports betting.

Visa shared the following with Independent Community Bankers of America (ICBA) in response to the inquiry on Visa’s actions relative to the overturn of the PASPA.
